Thumb Coast Tech provides technology consulting services, custom software development, website development, and related services. Our services include but are not limited to:

  • ERP and MES consulting and implementation
  • Custom software development
  • Website design and development
  • System integration services
  • Technical support and maintenance
  • Site monitoring and status notifications

3. User Accounts

Some features of our services may require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to terminate or suspend accounts that violate these Terms.

4. SMS/Text Message Terms

By opting in to receive SMS notifications from Thumb Coast Tech, you agree to the following:

  • Program Name: Thumb Coast Tech Service Alerts
  • Purpose: Receive service status alerts, outage notifications, account updates, and important service-related communications
  • Message Frequency: Message frequency varies based on account activity and service events. You may receive up to 10 messages per month.
  • Message and Data Rates: Message and data rates may apply. Contact your mobile carrier for details about your text messaging plan.
  • Opt-Out: Reply STOP to any message to stop receiving SMS notifications. You will receive a confirmation message.
  • Help: Reply HELP to any message for assistance, or contact us at mmedwith@thumbcoasttech.com
  • Supported Carriers: Major US carriers are supported. Carriers are not liable for delayed or undelivered messages.

Your consent to receive SMS messages is not a condition of purchase. You can use our services without opting in to SMS notifications.

5. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Transmit viruses, malware, or other harmful code
  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others

6. Intellectual Property

All content, features, and functionality of our website and services are owned by Thumb Coast Tech, LLC and are protected by copyright, trademark, and other intellectual property laws.

Custom work created for clients is governed by individual service agreements.

7. Payment Terms

Payment terms for our services are specified in individual service agreements or invoices. Unless otherwise stated:

  • Payment is due within 30 days of invoice date
  • Late payments may incur interest charges
  • We reserve the right to suspend services for overdue accounts

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMB COAST TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from your use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Indemnification

You agree to indemnify and hold harmless Thumb Coast Tech, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

11. Termination

We may terminate or suspend your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on this page. Your continued use of our services after such changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
